iCleaner Terms of Service

Welcome to iCleaner! These Terms of Service ("Terms," "Agreement") govern your access to and use of the iCleaner mobile application ("App," "Service," "iCleaner") provided by iCleaner ("we," "us," "our"). By downloading, installing, accessing, or using iCleaner, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By creating an account, accessing, or using iCleaner on Android or iOS devices, you acknowledge that:

• You have read, understood, and agree to be bound by these Terms
• You have read and agree to our Privacy Policy, which is incorporated into these Terms by reference
• You are at least 13 years of age (or the minimum age in your jurisdiction)
• You have the legal capacity to enter into this binding agreement
• If using the App on behalf of an organization, you have authority to bind that organization to these Terms
• You consent to in-app advertising through Google AdMob in the free version and in-app purchases through Apple App Store and Google Play Store as described in Section 5

These Terms apply to all users of the App, including free users and premium subscribers.

2. Description of Service

iCleaner is a mobile phone optimization application that provides the following features and services:

2.1 Core Features (Free Version with Ads)

• Junk File Cleaning: Scan and remove cache files, temporary files, residual files, and unnecessary system files
• Storage Analysis: Analyze device storage usage and provide recommendations for optimization
• Duplicate File Detection: Identify and remove duplicate photos, videos, and documents
• Contact Cleanup: Merge duplicate contacts and remove empty or incomplete contact entries
• Media Management: Organize photos and videos, identify blurry or low-quality images
• Basic Secure Vault: Store limited private files with password/biometric protection
• Email Inbox Cleaner: Identify and help remove unnecessary emails and attachments
• Google AdMob Ads: Free version displays advertisements to support app development

2.2 Premium Features (In-App Purchase/Subscription)

• Unlimited secure vault storage
• Advanced file compression tools
• Cloud backup for vault files
• Priority customer support
• Ad-free experience (no Google AdMob advertisements)
• Advanced AI-powered cleaning recommendations
• Automatic scheduled cleaning
• Browser and ad cache cleanup

2.3 Monetization Through Advertising and In-App Purchases

iCleaner is supported through two monetization methods:

• Advertising: The free version displays advertisements served by Google AdMob
• In-App Purchases: Premium features are available through optional in-app purchases and subscriptions processed by Apple App Store and Google Play Store

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice.

3. User Accounts and Registration

3.1 Account Creation

While basic features may be available without registration, certain features require you to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us of any unauthorized access or security breach. We are not liable for any loss or damage arising from your failure to protect your account information.

3.3 Account Termination

You may delete your account at any time through the App settings. Upon account deletion:

• Your account information will be permanently deleted within 30 days
• Active subscriptions will continue until the end of the billing period unless canceled in App Store/Play Store settings
• Local data on your device will remain until you uninstall the App
• Vault files will be permanently deleted unless backed up externally

4. User Responsibilities and Acceptable Use

4.1 Permitted Use

You may use iCleaner for personal, non-commercial purposes to optimize and maintain your mobile device. You agree to use the Service in compliance with all applicable laws and regulations.

4.2 Prohibited Activities

You agree NOT to:

• Use the App for any illegal, fraudulent, or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, circumvent, or disable any security features or protections
• Bypass or disable ad blocking mechanisms or attempt to prevent advertisement display
• Use automated systems (bots, scrapers) to access the Service
• Interfere with or disrupt the App's functionality or servers
• Upload malicious code, viruses, or harmful content
• Violate any applicable laws or third-party rights
• Attempt to gain unauthorized access to other users' accounts or data
• Use the App to store or transmit illegal content
• Sell, rent, lease, or redistribute the App without authorization
• Create derivative works based on the App
• Use the App in a manner that could damage our reputation
• Attempt to commit ad fraud or manipulate in-app purchase systems
• Use VPNs or other tools to circumvent regional ad restrictions

4.3 Vault Content Responsibility

You are solely responsible for the content you store in the secure vault. You represent and warrant that:

• You own or have the right to store all vault content
• Vault content does not violate any laws or third-party rights
• Vault content does not contain illegal material, including child exploitation content
• You will not use the vault to store or distribute unlawful content

5. Subscriptions, In-App Purchases, and Payments

5.1 Premium Subscription and In-App Purchases

iCleaner offers premium subscriptions and in-app purchases to unlock additional features and remove advertisements. Available purchase options include:

• Monthly subscription (auto-renewing)
• Annual subscription (auto-renewing, discounted rate)
• Lifetime premium access (one-time purchase)
• Individual premium features (as applicable)

5.2 Payment Processing and Billing

All in-app purchases and subscriptions are processed through Apple App Store (iOS) and Google Play Store (Android). By making a purchase, you agree that:

• Payment will be charged to your Apple App Store or Google Play Store account at confirmation of purchase
• For subscriptions, you will be charged for the selected period (monthly or annual)
• Subscriptions automatically renew at the end of each billing period unless auto-renewal is disabled
• You will be notified before renewal with the amount to be charged
• Your account will be charged for renewal within 24 hours prior to the end of the current billing period
• You are responsible for all charges incurred from your account
• You can manage subscriptions and disable auto-renewal in your device's App Store/Play Store settings
• Prices are in USD or your local currency equivalent and are subject to change with advance notice
• All prices include applicable taxes where required
• Apple and Google, not iCleaner, process all payment transactions and have access to your payment information

5.3 Free Trials

We may offer free trial periods for premium features. Terms for free trials include:

• Free trials are available only to users who have not previously purchased premium features
• Free trials are limited to one trial period per user, unless otherwise specified
• At the end of the trial period, your account will be automatically charged the full subscription fee unless you cancel before the trial ends
• To cancel a free trial and prevent charges, you must disable auto-renewal in your App Store/Play Store settings at least 24 hours before the trial period ends
• We may modify or terminate trial offers at any time with reasonable notice
• Trial eligibility is determined at our discretion and is subject to Apple and Google's policies

5.4 Refund Policy

All purchases and subscriptions are processed through Apple App Store and Google Play Store and are governed by their respective refund policies:

App Store Refund Windows: Apple generally grants refunds for in-app purchases made within 14 days if requested within 14 days of purchase. Google has similar policies.

Direct Contact: In exceptional circumstances, you may contact us at phone.icleaner@gmail.com with details of your purchase, and we may assist by facilitating a request with Apple or Google. However, the final decision on refunds rests exclusively with Apple and Google, and we cannot guarantee refund approval.

Note: We do not process refunds directly. All refund requests must be directed to Apple or Google through their official channels.

5.5 Subscription Management and Cancellation

You may manage, modify, or cancel your subscription at any time:

To Cancel or Modify Your Subscription:

• iOS: Go to Settings → [Your Name] → Subscriptions, select iCleaner, and tap "Cancel Subscription"
• Android: Go to Google Play Store → Account → Subscriptions, select iCleaner, and tap "Cancel"
• Alternatively, access subscriptions directly in the iCleaner app through Settings → Subscription

Effects of Cancellation:

• Premium access will continue until the end of your current billing period
• No refund will be provided for the remaining portion of the current billing period
• After the current period ends, your account will revert to the free version
• Premium features will no longer be available
• You will begin seeing advertisements from Google AdMob
• Vault files will remain accessible but may be limited to the free tier storage

5.6 Price Changes

We reserve the right to change subscription pricing with reasonable advance notice. You will be notified of price changes before your next renewal date. If you do not agree to new pricing, you may cancel your subscription before the price change takes effect.

5.7 Payment Problems

If your payment method fails or is declined:

• Apple or Google will attempt to charge your account again at a later date
• Your subscription may be suspended until a valid payment method is provided
• Repeated payment failures may result in account deactivation
• Contact Apple Support or Google Play Support if you need to update your payment method

6. Advertising (Google AdMob)

6.1 In-App Advertising

iCleaner displays advertisements in the free version through Google AdMob. By using the free version, you agree to:

• View and interact with advertisements served by Google AdMob
• Allow Google and third-party advertisers to serve ads within the App
• Comply with advertiser terms and clicking on ads only when genuinely interested
• Not interfere with ad display or attempt to block advertisements

6.2 Ad Frequency and Placement

We aim to balance user experience with monetization. Advertisements appear:

• Between cleaning operations (interstitial ads)
• At the bottom of screens (banner ads)
• During optimization processes (video ads)

Ad frequency may vary based on your usage patterns and device specifications.

6.3 Premium Ad-Free Experience

By purchasing a premium subscription, you can remove all advertisements. Premium users will not see:

• Google AdMob banner ads
• Interstitial advertisements
• Video advertisements
• Any third-party promotional content

6.4 Google AdMob Policies and Data Collection

Advertisements are served by Google AdMob in accordance with:

• Google's Privacy Policy
• Google AdMob Terms of Service
• Google's Ad Technology Policies

Google collects and uses data for ad personalization as described in their privacy policies. Your interaction with ads is governed by Google's terms, and we encourage you to review their policies.

6.5 User Control Over Ads

You have the following options to control ad personalization:

• iOS: Go to Settings → Privacy → Apple Advertising → turn off "Personalized Ads" or reset your Advertising ID
• Android: Go to Settings → Google → Manage Your Google Account → Data & Privacy → Ad personalization → turn it off or reset your ID
• Google Ad Settings: Visit https://adssettings.google.com to manage preferences
• Purchase Premium: Subscribe to remove all ads completely

Even if you disable personalized ads, you will still see advertisements, but they may be less relevant to your interests.

6.6 No Responsibility for Third-Party Ads

We are not responsible for:

• The content, accuracy, or quality of advertisements
• The behavior or policies of advertisers or third-party ad networks
• Transactions or interactions you have with advertisers
• Links to third-party websites or content accessed through ads
• Any claims or disputes arising from advertisements

If you click on an ad and interact with a third-party advertiser, your interactions are governed by that advertiser's terms and privacy policies, not ours.

6.7 Prohibited Ad Behavior

You agree not to:

• Click on advertisements with no genuine interest in the advertised product or service
• Use ad fraud techniques or automated tools to artificially inflate ad impressions or clicks
• Manipulate ad performance metrics or engage in click fraud
• Use VPNs to circumvent regional ad restrictions or manipulate ad serving
• Interfere with the technical delivery of advertisements

Violation of ad policies may result in account suspension or termination.

7. Intellectual Property Rights

7.1 Our Intellectual Property

iCleaner, including all content, features, functionality, source code, algorithms, user interface, graphics, logos, and trademarks, is owned by us and protected by international copyright, trademark, and other intellectual property laws. You acknowledge that:

• The App is licensed to you, not sold
• We retain all rights, title, and interest in the App
• You do not acquire any ownership rights through use of the App
• All trademarks, service marks, and logos are our property

7.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal devices
• Use the App for personal, non-commercial purposes
• Access and use features in accordance with these Terms

This license automatically terminates if you violate these Terms.

7.3 Your Content

You retain ownership of all files, photos, videos, and content you store in iCleaner. By using the App, you grant us a limited license to:

• Store your content locally on your device
• Process your content to provide App functionality (cleaning, compression, analysis)
• Back up encrypted vault content to cloud storage (if you enable this feature)

We do not claim ownership of your content and will not use it for any purpose other than providing the Service.

8. Data Backup and Loss

8.1 Your Responsibility to Backup

You are solely responsible for backing up important files before using cleaning features. While iCleaner is designed to safely identify and remove only unnecessary files, we strongly recommend:

• Creating backups of important data before using the App
• Reviewing files before confirming deletion
• Using the vault feature for critical files
• Maintaining external backups of irreplaceable content

8.2 No Liability for Data Loss

To the maximum extent permitted by law, we are not liable for any data loss, corruption, or damage that may occur from:

• Using the App's cleaning or optimization features
• Accidental deletion of files
• Device malfunction or software errors
• Failure to backup data
• Third-party interference or security breaches

9. Third-Party Services and Links

iCleaner may contain links to third-party websites, apps, or services. Additionally, advertisements may link to third-party sites. We do not control, endorse, or assume responsibility for any third-party content or services. Your use of third-party services is governed by their respective terms and privacy policies. We are not liable for any damages or losses caused by third-party services.

10. Disclaimers and Warranties

10.1 "As Is" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be error-free, uninterrupted, or secure
• Warranties regarding the accuracy, reliability, or completeness of content
• Warranties that defects will be corrected
• Warranties that advertisements will not be intrusive or objectionable
• Warranties regarding the performance of in-app purchases or subscriptions

10.2 Performance Disclaimer

We do not guarantee that iCleaner will:

• Improve your device performance by any specific amount
• Free up any specific amount of storage space
• Resolve all device issues or problems
• Be compatible with all devices, operating systems, or configurations
• Meet your specific requirements or expectations

Results may vary based on device condition, usage patterns, and other factors beyond our control.

10.3 No Professional Advice

iCleaner provides automated recommendations and analysis tools but does not provide professional advice. The App's recommendations should not be considered professional technical advice. You should exercise your own judgment when using the App's features.

11. Limitation of Liability

11.1 Liability Limitations

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ICLEANER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Indirect, incidental, consequential, punitive, or special damages
• Lost profits, revenue, data, or business opportunities
• Device damage or malfunction
• Data loss or corruption
• Personal injury or property damage
• Any damages arising from use or inability to use the App
• Issues with Google AdMob advertisements or third-party advertisers
• Problems with in-app purchases, subscriptions, or billing

11.2 Maximum Liability

Our total liability to you for any claims arising from your use of iCleaner shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

11.3 Essential Purpose

Some jurisdictions do not allow limitation of liability for certain damages. If your jurisdiction does not allow such limitations, the above limitations may not apply to you, but our liability shall be limited to the fullest extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless iCleaner, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws or regulations
• Content you store in the vault or process through the App
• Your negligent or willful misconduct
• Your interaction with advertisements or advertisers
• Your use of in-app purchase features

13. Modifications to Terms and Service

13.1 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify you through the App or via email for material changes
• Provide reasonable time to review changes before they take effect

Your continued use of iCleaner after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and may delete your account.

13.2 Changes to Service

We may modify, suspend, or discontinue any feature of the Service at any time, with or without notice. This includes:

• Adding or removing cleaning features
• Changing subscription pricing or features
• Modifying advertising frequency or format
• Changing in-app purchase options or pricing
• Updating vault storage limits

We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Termination

14.1 Termination by You

You may terminate these Terms at any time by:

• Uninstalling the App from your device
• Deleting your account through App settings
• Ceasing all use of the Service

14.2 Termination by Us

We may suspend or terminate your access to the App immediately, without prior notice or liability, if you:

• Violate these Terms or our policies
• Engage in fraudulent or illegal activities
• Threaten the security or integrity of the Service
• Violate the rights of other users or third parties
• Fail to pay subscription fees (for premium users)
• Engage in ad fraud or manipulate in-app purchase systems

14.3 Effects of Termination

Upon termination of your account:

• Your right to use the App immediately ceases
• Your account data will be deleted according to our retention policies
• You will lose access to premium features (if applicable)
• No refunds will be provided for unused subscription periods
• Provisions intended to survive termination shall remain in effect

15. Dispute Resolution and Arbitration

15.1 Informal Dispute Resolution

Before filing a claim, you agree to contact us at phone.icleaner@gmail.com to attempt to resolve the dispute informally. Provide a detailed description of the dispute and your desired resolution. We will attempt to resolve the dispute within 60 days of receiving your notice.

15.2 Binding Arbitration

If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the rules of a recognized arbitration association. Arbitration will take place in a neutral location or online as agreed by the parties. The arbitration shall be conducted in English.

15.3 Class Action Waiver

YOU AND ICLEANER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You agree to waive any right to participate in class action lawsuits or class-wide arbitration.

15.4 Exceptions

Either party may bring a claim in small claims court if the claim qualifies. Additionally, either party may seek injunctive or other equitable relief in court to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where iCleaner operates, without regard to its conflict of law provisions. Any dispute not subject to arbitration shall be brought in the courts of competent jurisdiction in that location.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and iCleaner regarding use of the App and supersede all prior agreements and understandings.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely approximates the intent of the original provision.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative.

17.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms or our rights under these Terms without your consent in connection with a merger, acquisition, or sale of assets.

17.5 Language

These Terms are written in English. Any translations provided are for convenience only. In case of conflict between the English version and a translated version, the English version shall prevail.

17.6 Apple and Google App Store Terms

If you download iCleaner from the Apple App Store or Google Play Store, you acknowledge and agree that:

• These Terms are between you and iCleaner, not Apple or Google
• Apple and Google have no obligation to provide maintenance or support services
• Apple and Google are not responsible for the App or its content
• Apple and Google are not responsible for addressing any claims related to the App, in-app purchases, or subscriptions
• Apple and Google are third-party beneficiaries of these Terms and may enforce them
• You must comply with all applicable third-party terms when using the App
• Apple App Store Terms and Google Play Store Terms apply to your use and download of the App
• In-app purchases and subscriptions are processed by Apple and Google and governed by their respective terms

17.7 Google AdMob Terms

By using iCleaner with advertisements displayed, you agree to:

• Comply with Google AdMob's terms of service and policies
• Allow Google to serve advertisements within the App
• Allow Google to collect data for ad personalization as described in their privacy policies
• Acknowledge that Google is a third-party beneficiary of these Terms
